Council approves Budget costings for legal teams in the Travellers Appeal. ---------------------------------------------------------------------------------------------------------------

There is a Council meeting at Lytham Lowther Pavilion on Monday 27th September at 7pm.During this meeting the Council will debate an unfunded budget increase in respect of land at Fairfield Road Hardhorn.This part of the meeting will not be open to the public. I will voice my support for such funding to be approved in order to support the legal issues connected with this land

There The planning Inspectorate have advised us that the inquiry into the appeal will be heard on the 8th February 2010.The appeal will be heard at the Town Hall St Annes and may last  for Five day's

Planning permission for the traveller site was refused by the council’s Development Control Committee on 2 June. The travellers have a statutory right to appeal within six months of that decision. However, the injunction granted in February required any appeal to be lodged within 28 days of the application decision being notified to them.

The application decision was dispatched on 8 June, which means that the 28 days runs out on 6 July. If no appeal has been lodged by then, the council will consider whether to apply for an injunction to end the use of the land as a caravan site. That consideration would be by the Development Control Committee. The committee would need to take into account all relevant matters, including the human rights of the travellers, in reaching any decision about applying for a further injunction.

The enforcement notice was served on the traveller’s site at Fairfield Road this morning.

A copy was left with the named individuals or attached to their plots and a copy left at each caravan by either giving a copy to the occupier or left in a plastic wallet and taped to a window. Copies were also fastened to several plots.

A registered copy was posted to Keith Gibson in Bradford, and a copy sent via normal post.

The council’s Development Control Committee refused planning permission for the change of use of the land to a caravan site on the 2nd June. Up to now, the applicants have not appealed against the refusal. The same meeting also decided to issue an enforcement notice. The enforcement notice has been issued. It requires the removal of caravans and the return of the site to the condition it was prior to November 6th last year. The site owner can appeal against the enforcement notice. Any appeal must be made before the end of August. If no appeal is lodged the notice comes into effect on the 1st September and gives four months (end of December) for the requirements of the notice to be achieved.

We are currently seeking further specialist legal advice on the most appropriate way to resolve the issues around the Fairfield Road land, consistent with the refusal of planning permission. The Development Control Committee will discuss that advice at a special meeting. Because the advice will be subject to legal professional privilege, the meeting will not be open to the public.

There have been a number of complaints about breaches of the existing injunction granted by the court in February. These have been investigated. We will pursue contempt of court application's in respect of these breaches where we have been able to find strong evidence against individuals responsible for breaches and where doing so would be a sensible use of public resources.
